Notice is hereby given in terms of the National Environmental Management Act, 1998 (Act No. 107 of 1998) as amended (NEMA), and the adopted Norm for the Exclusion of Identified Activities Associated with the Development and Expansion of Battery Storage Facilities in Areas of Low or Medium Environmental Sensitivity which allows for the exclusion from the requirement to obtain an Environmental Authorisation (EA) from the competent authority for listed and specified activities identified in Paragraph 3 of the Norm, in terms of Government Notice (GN). 4557, published in Gazette No. 50387, 27 March 2024, that Tharisa Minerals (Pty) Ltd (herein referred to as Tharisa) intends to submit an application for Registration for Exclusion from the requirement to obtain an EA for the proposed Tharisa Battery Energy Storage System (BESS) Development, situated in the Rustenburg Local Municipality, forming part of the Bojanala Platinum District Municipality (BDM), North West Province. The proposed development will be located within the Tharisa Mine on Portion 317 of Farm K/Kraal 342 JQ.

Tharisa is implementing a photovoltaic (PV) solar power system to supply clean energy to the Administration and Training Centre facilities at the Tharisa Mine. To maximise the benefits of this renewable energy investment and to ensure reliable power availability during morning and evening peak loads, a BESS capable of storing excess solar generation is required. The BESS is designed to store electricity and provide immediate power when needed. This improves grid stability, supports renewable energy integration, offers ancillary services, helps manage network constraints, and aids in meeting peak demand. Redox One, a developer and manufacturer of Iron Chromium (Fe Cr) flow batteries for industrial scale energy storage, is uniquely positioned to support this requirement. Arxo Metals (Pty) Ltd (hereunder referred to as Arxo Metals) currently manufactures the Fe-Cr electrolyte used in these batteries; utilising materials sourced from the Tharisa Mine. Redox One proposes to implement a demonstration project by installing its RFB 625 BESS, enabling a micro grid solution that delivers clean, reliable energy to the Administration and Training Centre facilities, while showcasing the performance of Fe-Cr flow battery technology.

Manyabe Consultancy (Pty) Ltd (MC) has been appointed as an Independent Environmental Assessment Practitioner (EAP), to undertake the registration process on behalf of Tharisa. In terms of GN. 4557, published in Gazette No. 50387 on 27 March 2024, for the proposed development of the BESS and its associated infrastructure, registration is being sought from the North West Department of Agriculture and Rural Development (NWDARD) from exclusion from Listing Notice No.1: Activity, 14 from the requirement of obtaining an EA.

Notice is given in terms Section 41 of Government Notice Regulation (GNR.) No. 982 in Government Gazette No. 38202 (04 December 2014), as amended, of the Environmental Impact Assessment (EIA) Regulations, 2014, as amended, promulgated in terms of Section 24(5) and 44 of the of the National Environmental Management Act, 1998 (Act No.107 of 1998), as amended (NEMA); and Section 38(3)(b) of the National Environmental Management: Air Quality Act, 2004 (Act No. 39 of 2004) (NEMAQA), for the Air emissions License (AEL) Application, that Arxo Metals (Pty) Ltd (herein referred to as Arxo Metals) [Arxo Metals is owned by Tharisa Minerals (Pty) Ltd (Tharisa); and specialises in the research, development, design and manufacturing of ferroalloys, from smelting various ores) is intending to acquire an AEL for the existing Arxo Metals R&D Facility (herein referred to as AMRD).

AMRD is located on number 15, Piet Pretorius Street, Brits i.e. Portion 0 of Erf 2236, Brits Extension 14, Registration Division JQ, within the Madibeng Local Municipality, Bojanala Platinum District Municipality (BDM), North West Province. Access to the site is from Piet Pretorius Street. The facility is within an urban area (an industrial node) and is surrounded by warehouses and businesses. The Erf portion on which the plant is situated is currently registered in the name of Autocast South Africa.

Manyabe Consultancy (Pty) Ltd (MC) was appointed by Arxo Metals as an independent Environmental Assessment Practitioner (EAP) to undertake the Atmospheric Emission Licence (AEL) Application through a Scoping and Environmental Impact Reporting (S&EIR) process in terms of the NEMA and the NEMAQA, in order to obtain an Environmental Authorisation (EA) and an AEL, respectively. The EA and AEL applications were submitted to the North West Department of Economic Development, Environment, Conservation and Tourism (NW DEDECT) and the Bojanala District Municipality (BDM), respectively.

The EA application was subsequently withdrawn, as the operation of the facility did not trigger any listed activities in terms of the NEMA EIA Regulations, 2014, as amended. In accordance with GNR 893 of 22 November 2013 (Government Gazette 37054), as amended, and Section 21 of NEMAQA (Sub-categories 4.1, 4.9, and 4.16), the AEL application process proceeded. A Provisional AEL (PAEL) was issued in terms of Sections 37, 40(1)(a), and 46 of NEMAQA on 20 February 2024, one year after the application was lodged on 20 February 2023.

Updated application forms were submitted on 09 September 2024, followed by the submission of additional information on 30 September 2024, which included a correction to the number of stacks (six in total). As a result of this correction, and due to changes and decommissioning of certain facility units, an amended PAEL was issued on 09 October 2024, valid until 19 February 2025.

A further application was submitted on 21 January 2025. The PAEL issued on 20 February 2024 was made available for public review from 13 March 2025 to 14 April 2025. The Public Participation Process (PPP) report was subsequently submitted to the BDM on 24 April 2025. An amended PAEL was issued on 08 May 2025, valid until 07 May 2026, which necessitated the submission of the current application. It should be noted that the present application is for an AEL with a validity period of five (5) years.

No. 982 in Government Gazette No. 38202 (04 December 2014), as amended, of the Environmental Impact Assessment (EIA) Regulations, 2014, as amended, promulgated in terms of Section 24(5) and 44 of the National Environmental Management Act, 1998 (Act No.107 of 1998), as amended (NEMA), that the South African Nuclear Energy Corporation (Necsa) is proposing to undertake Phase 2 Part II of the Geotechnical and Geophysics Survey, including Seismic Survey studies, in support of the proposed Multi-Purpose Reactor (MPR) project at its Pelindaba site just outside of Pretoria in the North West Province.

The proposed Phase 2 Part II of the Geotechnical and Geophysics Survey, including Seismic Survey studies, will be carried out in phases. The work envisaged for the preferred site is itemised as follows: rotary-core boreholes; test pits; Continuous Surface Waves (CSW); down-the-hole seismic testing. Ten rotary core (RC) boreholes will be drilled to depths between 15 m and 35 m. The boreholes will include Standard Penetration Tests (SPT) at 1.5m intervals. Undisturbed Shelby Tube samples, and rock core samples will be retrieved for subsequent testing. All boreholes will have piezometers installed, and all borehole core boxes will be photographed. Eight (8) test pits will be excavated to the maximum reach of the TLB or refusal and will be photographed, profiled and sampled, and backfilled upon completion. All profiling of test pits and logging of borehole cores will be undertaken by experienced engineering geologists according to the current South African guidelines (Brink and Bruin, 2002). The extent of disturbance is estimated at 15 000m².

Manyabe Consultancy (MC) has been appointed by Necsa as an independent Environmental Assessment Practitioner (EAP), to undertake an Environmental Authorisation (EA) Application process in terms of the NEMA. The EA Application will be submitted to the Department of Forestry, Fisheries and the Environment (DFFE).

Considering that the proposed site is situated in a Critical Biodiversity Area (CBA), the following NEMA EIA listed activities will be triggered by the proposed Phase 2: Part II studies: GNR. 327: Listing Notice No.1: Activity 27 and GNR. 324: Listing Notice No.3: Activity 12, thus the application process to be followed to obtain EA is by way of a Basic Assessment (BA) process. The Competent Authority for the NEMA BA process is the DFFE.

The proposed bulk outfall sewer pipeline upgrade starts at the corner of Lake Road and Ermelo Road at geographical coordinates of 26° 15’ 14.91” S and 28° 27’ 31.79” E and terminates at Anchor Water Care Works (WCW) at geographical coordinates of 26° 16’ 13.93” S and 28° 28’ 43.25” E. The proposed bulk outfall sewer pipeline measures approximately 3 034.69m in total length and consists primarily of two sections, namely, the bulk outfall sewer pipeline section (excluding the pipe bridge section), which mostly runs along Ermelo Road and terminates adjacent to Mentz Street and Broom Road, and also the pipe bridge section that crosses over Erf R/117/125-IR and terminates at the Anchor WCW.

The proposed bulk outfall sewer pipeline section (excluding the pipe bridge section) consists of a high-density polyethylene (HDPE) pipeline that will replace the existing Vitreous Clay pipeline, measuring approximately 2 250.85m in length. The pipe bridge section, on the other hand, consists of a 3CR12 Stainless Steel pipeline that will replace the existing Coated Mild Steel pipeline, measuring approximately 783.84m in length. Further to the above, the project will involve the rectification of the incorrect gradients at a section of the pipeline spanning approximately 322m, between manholes SPR_09656 to SPR_09660, located along Ermelo Road at the start of the outfall sewer system.

Manyabe Consultancy (Pty) Ltd (MC) has been appointed as an independent Environmental Assessment Practitioner (EAP), to undertake Environmental Authorisation (EA) and Water Use Licence Application (WULA) processes on behalf of the CoE. The EA and the WULA will be submitted to the Gauteng Department of Agriculture, Rural Development and Environment (GDARDE) and the Department of Water and Sanitation (DWS), respectively.

No. 267 in Government Gazette No. 40713 (24 March 2017), of the National Water Act, 1998 (Act No.36 of 1998) (NWA) that the City of Ekurhuleni Metropolitan Municipality (CoE) intends to submit a Water Use License Application (WULA) to the Department of Water and Sanitation (DWS) for the proposed rerouting of the Brakpan Outfall Sewer Pipelines which are located within the 500m radius from the delineated boundary (extent) of a wetland. Water uses listed under section 21 (c) and (i) of the NWA, will be triggered by the proposed project.

The project is located within the Brakpan area, which forms part of the CoE in Gauteng Province. The proposed project involves the upgrade of the existing sewerage infrastructure, namely segments J1.1, J1.2, J1.3 and the bulk outfall sewer pipeline. The outfall sewer pipeline begins at the manhole located on Prince George Avenue and runs along the side road towards the junction with Escombe Street. The outfall sewer pipeline further runs through the property within the sports fields towards Elliot Street along the lower entrance of the Brakpan Customer Care Center (CCC) towards the Jan Smuts Wastewater Treatment Works (WWTW). The upgrading of the segments/infrastructure entails the continued gravitational drainage via outfall sewers towards Jan Smuts WWTW. Segments J1.1, J1.2, J1.3 and bulk outfall sewer segment are currently used to drain sewage from drainage areas 1, 2, 3 and 4, respectively within the Brakpan Central Area.

The dimensions of the existing pipeline segments and the proposed pipeline upgrades are as follows: Section J1.1: current length = ±24m; current diameter = 200mm; proposed length = ±74m and proposed diameter 250mm. Section J1.2: current length = ±215m; current diameter = 200mm; proposed length = ±159m and proposed diameter = 200mm to 250mm. Section J1.3: current length = ±87m; current diameter = 200mm; proposed length = ±69m and proposed diameter 250mm = 300mm. Bulk outfall sewer pipeline current length = ±2 200m; current diameter = 450mm; proposed length = ±1 922m and proposed diameter = 450mm.

Ngatia Trading Company appointed Manyabe Consultancy (Pty) Ltd (MC) as an independent Environmental Assessment Practitioner (EAP), to undertake the NEMA Section 24G rectification application for the unlawful commencement of listed activities. In terms of GNR 327 (Listing Notice No.1: Activities 12 and 19) and GNR 324 (Listing Notice No. 3: Activities 12 and 14), an Environmental Authorisation (EA) application process should have been followed in order to obtain an EA from the GDARDE, to commence with listed activities. No. 982 in Government Gazette No. 38202 (04 December 2014), as amended, of the Environmental Impact Assessment (EIA) Regulations, 2014, as amended, promulgated in terms of Section 24(5) and 44 of the of the National Environmental Management Act, 1998 (Act No.107 of 1998), as amended (NEMA), that the City of Ekurhuleni Metropolitan Municipality (hereafter referred to as the CoE) are intending to construct the Masetjaba bulk main feeder and delivery water pipelines, and associated infrastructure (booster pumpstation).

The proposed project is intended to reinforce water supply to the new Masetjaba Reservoir Zone and accommodate future developments in Tsakane and its extensions. The total system comprises a delivery water pipeline (4.7km x 550mm diameter) and a feeder water pipeline (3.6km x 500mm diameter), with a total length of approximately 8.3km. The delivery water pipeline starts at a new Rand Water (RW) connection point in the west and runs along the R550 road reserve to the existing Masetjaba Reservoir complex. The feeder water pipeline begins at the existing Masetjaba Reservoir complex and runs along the R550 road reserve before skirting just south of the Spaarwater Pan to reach the new RW connection and booster pump station. The entire route traverses Spaarwater 171IR, Grootfontein 165IR, Zonnestraal 163IR and Vlakfontein 161 IR farm portions. The feeder water pipeline crosses a stream.

Manyabe Consultancy (Pty) Ltd (MC) has been appointed as an independent Environmental Assessment Practitioner (EAP), to undertake Environmental Authorisation (EA) process on behalf of the CoE. The EA application will be submitted to the Gauteng Department of Agriculture, Rural Development and Environment (GDARDE).

In terms of GNR. 327 [Listing Notice No.1: Activity 19]; and GNR. 324 [Listing Notice No.3: Activities 12 and 14], a Basic Assessment (BA) process is required in order to obtain an EA from the GDARDE. Water uses listed under section 21 (c) and (i) of the National Water Act, 1998 (Act No.36 of 1998) (NWA) will be triggered by the proposed project. The Erf portion on which the plant is situated is currently registered in the name of Autocast South Africa.

Manyabe Consultancy (MC) was appointed by Arxo Metals as an independent Environmental Assessment Practitioner (EAP), to undertake AEL Application – Scoping and Environmental Impact Reporting (S&EIR) process in terms of the NEMA and NEM: AQA, in order to obtain an EA and AEL, respectively. The proposed project for the installation of diesel storage tanks will be located within the existing mine situated on Portion 7 of the Farm Doornpoort 347IQ in the Westonaria, Rand West City Local Municipality, within the West Rand District Municipality. The co-ordinates of the centre point of the site are 26°25’3.98″ South, and 27°39’19.61″ East. The structure of the proposed diesel storage tanks will be horizontal with a rectangle-like transverse section, vertical sides, a cambered top, a ridged bottom, and round corners. The proposed diesel storage tanks will be fitted in a container frame with a rear pump room and will have a bund wall, dispensing suction line, pump, filling, and delivery line. All materials to be used to construct the storage tanks will be able to withstand temperatures within the range of -40ºC to +70ºC without any effect on the strength of the basic structure.

No. 982 in Government Gazette No. 38202 (04 December 2014), as amended, of the Environmental Impact Assessment (EIA) Regulations, 2014, as amended, promulgated in terms of Section 24(5) and 44 of the National Environmental Management Act, 1998 (Act No.107 of 1998), as amended (NEMA), that the South African Nuclear Energy Corporation (Necsa) is proposing to undertake Phase 2 Part II of the Geotechnical and Geophysics Survey, including Seismic Survey studies, in support of the proposed Multi-Purpose Reactor (MPR) project at its Pelindaba site just outside of Pretoria in the North West Province.

The proposed Phase 2 Part II of the Geotechnical and Geophysics Survey, including Seismic Survey studies, will be carried out in phases. The work envisaged for the preferred site is itemised as follows: rotary-core boreholes; test pits; Continuous Surface Waves (CSW); down-the-hole seismic testing. Ten rotary core (RC) boreholes will be drilled to depths between 15 m and 35 m. The boreholes will include Standard Penetration Tests (SPT) at 1.5m intervals. Undisturbed Shelby Tube samples, and rock core samples will be retrieved for subsequent testing. All boreholes will have piezometers installed, and all borehole core boxes will be photographed. Eight (8) test pits will be excavated to the maximum reach of the TLB or refusal and will be photographed, profiled and sampled, and backfilled upon completion. All profiling of test pits and logging of borehole cores will be undertaken by experienced engineering geologists according to the current South African guidelines (Brink and Bruin, 2002). The extent of disturbance is estimated at 15 000m2.

Manyabe Consultancy (MC) has been appointed by Necsa as an independent Environmental Assessment Practitioner (EAP), to undertake an Environmental Authorisation (EA) Application process in terms of the NEMA. The EA Application will be submitted to the Department of Forestry, Fisheries and the Environment (DFFE).

Considering that the proposed site is situated in a Critical Biodiversity Area (CBA), the following NEMA EIA listed activities will be triggered by the proposed Phase 2: Part II studies: GNR. 327: Listing Notice No.1: Activity 27 and GNR. 324: Listing Notice No.3: Activity 12, thus the application process to be followed to obtain EA is by way of a Basic Assessment (BA) process. Tharisa Minerals (Pty) Ltd (Tharisa) operates an opencast mining operation that produces chrome and platinum group metals (PGM) concentrate located on Farms K/Kraal 342 JQ, Rooikoppies 297 JQ and Elandsdrift 467 JQ, south of Marikana in the Northwest Province. Tharisa holds existing Environmental Authorisations (EAs) and licences under the Mineral and Petroleum Resources Development Act, 2002 (Act No. 28 of 2002) (MPRDA), the National Environmental Management Act, 1998 (Act No. 107 of 1998), as amended (NEMA), the National Environmental Management: Waste Act, 2008 (Act No. 59 of 2008) (NEMWA) and the National Water Act, 1998 (Act No. 36 of 1998) (NWA) for the mining of the East, West and Far West open pits.

Tharisa is proposing to undertake an Integrated EA and Waste Management License (WML) application for new activities proposed to be conducted for future proofing the mining operation [Waste Rock Dumps (WRDs) and associated infrastructure; overpass access (bridge and gravel road); 275kV realignment and 88kV upgrade; Tailings Storage Facility (TSF) 3 slurry pipeline, TSF 1 Phase 1 conversion; lifting of the walls of TSF 1 Phase 2; and the salvage yard], incorporating additional properties into the approved Tharisa MR boundary; and the consolidation of the existing Environmental Management Programmes (EMPrs), EAs and WMLs into a single Environmental Impact Assessment (EIA) / EMPr (hereunder referred to as the proposed project). Manyabe Consultancy (Pty) Ltd (MC) has been appointed by Tharisa as an independent Environmental Assessment Practitioner (EAP), to undertake the EIA process to obtain the required authorisations for the proposed project.

The proposed project triggers the following listed activities:

Water uses listed under Section 21 (c), (g) and (i) of the National Water Act, 1998 (Act No. 36 of 1998) (NWA) will be triggered by the proposed project, and a Water Use Licence Application (WULA) must be undertaken to obtain a Water Use Licence (WUL) from the regional Department of Water and Sanitation (DWS). Additionally, amendments administrative to the already approved Integrated WUL will also be undertaken.

Availability of the Draft Scoping Report

The Draft Scoping Report for the above-mentioned project is available for public review and comment, for a period of 30 days from Friday, 26 September 2025 to Monday, 27 October 2025 on MC’s website (www.manyabeconsultancy.com) and at the following public place:

This letter serves as a formal invitation for you to formally register as an Interested and Affected Party (I&AP) and to participate in the Scoping and Environmental Impact Reporting (S&EIR) process for the proposed project, by completing the enclosed registration and comments sheet. Please return the comment sheet by Monday, 27 October 2025.
